This Privacy Policy explains how we collect, use, store, secure, transfer, disclose, and retain personal data when you create an account for, access, or use the FormuVet application, including any clinical, veterinary, medical, administrative, analytics, support, and AI-supported features.
1. Purpose and Scope
This policy applies to:
- Account holders, subscribers, administrators, and end users;
- Patients, pet owners, clients, or case subjects whose information is entered into the App by a user;
- Website, mobile app, API, and support interactions related to the App.
2. What Data We Collect
Depending on how you use the App, we may collect the following categories of data:
- Account and identity data: name, username, title, profession, employer or practice name; email address, phone number, billing address, and account credentials; subscription status, payment-related metadata, and transaction history.
- Technical and usage data: IP address, device identifiers, browser/app version, operating system, language, time zone, and approximate location inferred from IP; login history, session activity, clicks, pages viewed, feature usage, crash logs, diagnostic logs, and audit trails; cookies, local storage, and similar technologies where used.
- Clinical, veterinary, patient, and case data: case notes, history, exam findings, symptoms, diagnoses, treatment plans, medication information, laboratory and imaging results, attachments, and clinician-entered observations; patient or animal identifiers and linked owner/client information where entered by the user.
- AI interaction data: prompts, queries, uploaded documents, images, attachments, and outputs generated when you use AI-supported features; feedback you provide on AI outputs, including ratings, corrections, and follow-up instructions.
- Support and communications data: messages to customer support, bug reports, onboarding responses, training requests, and compliance inquiries.
3. Why We Process Your Data
We process personal data to:
- Create and manage user accounts and authenticate users;
- Provide clinical, administrative, and AI-supported functionality;
- Maintain records, logs, and audit trails;
- Secure the App, detect misuse, prevent fraud, and investigate incidents;
- Provide customer support and service communications;
- Bill, renew, and administer subscriptions;
- Improve performance, reliability, and usability;
- Comply with legal, regulatory, contractual, and professional obligations;
- Enforce our terms and protect our rights, users, patients, and the public.
4. How AI Features Process Data
If you use AI-enabled features, your prompts, attachments, case information, and related metadata may be processed by internal models and contracted subprocessors that provide model hosting, inference, storage, monitoring, or safety services.
Important: AI outputs may be inaccurate, incomplete, outdated, biased, or unsuitable for a particular case. AI features are assistive only and must be reviewed by an appropriately qualified human user before reliance or action.
5. Where and How Data Is Stored
Your data may be stored: in encrypted production databases; in encrypted backups; in secure cloud storage used for files and attachments; in monitoring and support platforms used to maintain the App.
We store data globally. We implement reasonable and appropriate technical and organizational safeguards designed to protect personal data.
6. Data Sharing and Disclosure
We may disclose personal data only as reasonably necessary for the purposes described in this notice, including to: cloud hosting, storage, analytics, authentication, logging, customer support, and security vendors; payment processors and subscription management providers; contracted AI or infrastructure providers used to deliver App functionality.
7. Retention
We keep personal data only for as long as reasonably necessary for the purposes described in this notice, including legal, security, support, contractual, accounting, and compliance purposes.
8. Your Rights
Subject to applicable law and verification of your identity, you may have the right to: access the personal data we hold about you; correct inaccurate or incomplete information; delete data in certain circumstances; restrict or object to certain processing; receive a portable copy of certain data; withdraw consent. By accessing, viewing, generating, receiving, or relying on any clinical content, recommendation, summary, alert, calculation, guideline reference, triage support, dosing aid, diagnostic support, treatment support, or other output from our application (the "App"), you ("User") acknowledge, understand, and agree as follows:
1. Decision-Support Only; Not Medical or Veterinary Advice
The App is provided solely as an informational and clinical decision-support tool. The App is not a substitute for professional veterinary advice, professional medical advice, independent diagnostic assessment, direct patient evaluation, or the clinical judgment of a qualified licensed professional. The App does not establish a veterinarian-client-patient relationship, physician-patient relationship, or any other professional care relationship.
2. No Replacement of Professional Judgment
The App is intended only to assist qualified users by organizing, summarizing, or presenting information for consideration. It is not intended to replace, override, control, or direct the independent professional judgment of any user, attending licensed veterinarian, licensed physician, or other authorized clinician. All App outputs must be independently reviewed, verified, and evaluated in light of the full clinical picture.
3. Up-to-Date References; No Guarantee of Accuracy
While the App may reference current or recently updated clinical guidelines, literature, protocols, formularies, consensus statements, and other professional resources, errors, omissions, inaccuracies, incomplete information, outdated information, misinterpretations, software defects, model limitations, data-mapping issues, and other failures are possible.
Accordingly, the Company, its affiliates, owners, officers, directors, employees, contractors, developers, licensors, contributors, and agents (collectively, the "Released Parties") make no representation or warranty that any App content or output is accurate, complete, reliable, current, clinically appropriate, legally compliant, safe, or fit for any particular purpose.
4. User Responsibility for Clinical Decisions
You acknowledge and agree that ultimate responsibility for all clinical decisions, professional judgments, diagnoses, differentials, prognoses, prescriptions, treatment plans, procedures, referrals, monitoring decisions, follow-up decisions, and any other acts or omissions relating to patient care rests solely and exclusively with:
- the User, to the extent the User acts on or relies upon the App; and/or
- the attending licensed veterinarian, licensed physician, or other duly authorized clinician responsible for the patient's care.
You further agree that you will not rely on the App as the sole basis for any diagnosis, treatment, prescribing decision, or other clinical action.
5. Verification Obligation
Before acting on any App output, you agree to independently confirm, where applicable:
- the identity of the patient;
- species, breed, age, weight, pregnancy/lactation status, and relevant physiologic parameters;
- allergies, sensitivities, contraindications, and drug interactions;
- dosage calculations and formulation strengths;
- product labeling and manufacturer instructions;
- jurisdiction-specific legal and regulatory requirements;
- whether in-person examination, direct assessment, further testing, referral, or emergency intervention is required.
6. No Emergency Reliance
The App is not guaranteed to identify emergencies, time-critical conditions, or all clinically significant abnormalities. The App must not be used as a substitute for immediate clinical evaluation, emergency triage, urgent referral, or other timely professional intervention where delay may cause harm.
7. Assumption of Risk
You voluntarily assume all risks arising from or related to the use of the App and any reliance on its outputs, including risks of error, omission, delay, misclassification, incorrect calculation, incomplete recommendations, technology failure, connectivity failure, data-entry error, interoperability error, and user misunderstanding or misuse.
8. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the App and all related outputs, content, and services are provided "as is," "as available," and with all faults. The Released Parties disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, satisfactory quality, availability, or suitability for clinical use.
9. Release and Hold Harmless
To the fullest extent permitted by law, you hereby release, waive, and agree to hold harmless the Released Parties from and against any and all claims, demands, actions, complaints, investigations, liabilities, losses, damages, judgments, settlements, penalties, costs, and expenses of any kind arising out of or relating to your access to or use of the App.
10. Indemnification
You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all third-party claims, demands, suits, proceedings, damages, liabilities, losses, fines, penalties, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use or misuse of the App, your breach of this notice, or your clinical decisions made in connection with the App.
11. Professional and Legal Compliance
You are solely responsible for ensuring that your use of the App complies with all applicable laws, regulations, licensing requirements, prescribing rules, recordkeeping obligations, privacy requirements, standards of care, institutional policies, and payer or formulary requirements in the jurisdiction(s) where you practice.
12. Condition of Access
Access to any clinical output, recommendation, or decision-support content is conditioned on your prior review and affirmative acceptance of this Liability Notice, Disclaimer, Release, and Indemnity. If you do not agree, you must not access or use any clinical output from the App.
13. Continued Use
Each access to or use of clinical outputs constitutes reaffirmation of this Liability Notice, Disclaimer, Release, and Indemnity.
